Protection of Personal Data

a) Data Controller

Pursuant to the Personal Data Protection Law No. 6698 (“Law No. 6698” or the “Law”), your personal data will be processed by ASKON DEMİR ÇELİK SAN. VE TİC. A.Ş. (the “Company”), acting as the data controller, within the scope explained below.


b) Purpose of Processing Personal Data

Your personal data / special categories of personal data collected within the scope of your job application (hereinafter collectively referred to as “personal data”) are processed for the following purposes:

  • Evaluation of your job application request and your suitability for the relevant position,

  • Carrying out and concluding recruitment processes within the framework of the Company’s human resources policies, classifying suitable candidates, evaluating candidates’ qualifications and competencies, and contacting you in this regard,

  • Ensuring the legal and commercial security of the Company and individuals who have a business relationship with the Company,

  • Determining and implementing the Company’s commercial and business strategies and improving and developing recruitment principles applied by the Company,

  • Carrying out the necessary work by relevant business units and managing related business processes in order to perform the Company’s commercial activities.


c) Personal Data to Be Processed

  • Identity data: Name, surname, date and place of birth, gender, marital status, nationality information

  • Contact data: E-mail address, address, mobile phone number

  • Special categories of personal data: Health status, disability information

  • Education data: Educational background, certificate and diploma information, areas of expertise, foreign language skills, education and skills, seminars and courses attended, computer skills, examination information

  • Work experience data: Total experience, employment status and title, work experience (company names, employment periods, job descriptions)

  • Visual and audio data: Photograph and audio recordings belonging to the individual

  • Other: Driver’s license information, competencies, salary expectations, military service status, reference information (name, surname, title, workplace, phone number, e-mail address of the reference person), and any Word, Excel, presentation files attached to your CV, as well as information stated in the job application form

For the personal data of reference persons included in your CV (name, surname, phone number, e-mail, etc.), informing such persons and obtaining their explicit consent is your responsibility.


d) To Whom and for What Purpose Personal Data May Be Transferred

Your collected personal data may be transferred, limited to the purposes specified, to legally authorized public institutions and private entities, our suppliers, and (provided that your explicit consent is obtained for special categories of personal data) our business partners, shareholders, affiliates, and group companies, in accordance with Articles 8 and 9 of Law No. 6698, for the purposes of:

  • Evaluating your job application and suitability for the relevant position,

  • Conducting and concluding recruitment processes, arranging English exam appointments, sending personality inventories through the system, obtaining work permits if necessary, directing candidates to health centers for medical examinations, and contacting you within this scope,

  • Ensuring the legal and commercial security of the Company and its business partners,

  • Determining and implementing the Company’s commercial and business strategies and improving recruitment principles.


e) Method and Legal Grounds for Collecting Personal Data

The Company collects and processes personal data through fully or partially automated methods and non-automated methods that form part of a data recording system, directly from you via phone calls, filling out forms in physical environments, and through automated systems (other websites enabling job applications, the Company’s website, data integration, and telephone channels).

Personal data are processed based on the legal grounds specified in Articles 5 and 6 of the Law, including:

  • Explicitly stipulated by laws,

  • Necessity to fulfill legal obligations,

  • Necessity for the establishment or performance of a contract,

  • Necessity for the legitimate interests of the Company,

  • Data made public by the data subject,

  • Necessity for the establishment, exercise, or protection of a right,

  • Explicit consent of the data subject.

Collected personal data will be stored for the retention period to be evaluated in the Company’s Human Resources processes and used in recruitment-related activities (provided that explicit consent exists for special categories of personal data).


f) Rights of the Data Subject under Article 11 of Law No. 6698

Data subjects may submit their requests regarding their rights to the Company using the methods described below. The Company will conclude such requests as soon as possible and no later than thirty (30) days, depending on the nature of the request. No fee will be charged for responses up to ten pages. For each page exceeding ten pages, a fee of 1 Turkish Lira will be charged. If the response is provided on a recording medium such as CD or flash drive, the fee will not exceed the cost of the medium.

Within this scope, data subjects have the right to:

  • Learn whether personal data are processed,

  • Request information if personal data have been processed,

  • Learn the purpose of processing personal data and whether they are used in accordance with this purpose,

  • Know the third parties to whom personal data are transferred domestically or abroad,

  • Request correction of incomplete or inaccurate personal data and request notification of such correction to third parties to whom data have been transferred,

  • Request deletion or destruction of personal data when the reasons requiring processing no longer exist, and request notification of such action to third parties,

  • Object to results arising against the individual due to analysis of data exclusively through automated systems,

  • Request compensation for damages incurred due to unlawful processing of personal data.

Requests may be submitted in Turkish and in writing or via registered electronic mail (KEP), secure electronic signature, mobile signature, or the e-mail address previously notified to the Company and registered in its system, in accordance with Article 13 of the Law and the Communiqué on Procedures and Principles of Application to the Data Controller dated 10.03.2018 and numbered 30356. The Company reserves the right to verify your identity before responding.

Applications must include:

  • Name, surname, and signature (if written),

  • Turkish ID number for Turkish citizens; nationality, passport number, or ID number for foreigners,

  • Address for service of notification or workplace address,

  • E-mail address, telephone, and fax number (if any),

  • Subject of the request and any relevant information and documents.

Depending on the nature of your request, complete and accurate information and documents must be provided. Failure to provide required information and documents may prevent the proper and effective evaluation of your request. In such cases, the Company reserves its legal rights. Therefore, applications must be submitted completely and in accordance with the nature of the request.
